Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you," "customer," or "buyer") and Outback Shipping Containers LLC ("Outback Shipping Containers," "we," "our," or "us"), a Texas limited liability company with its principal place of business at 10000 Wallisville Rd, Houston, TX 77013. By accessing, browsing, registering an account on, requesting a quote through, or purchasing from the website https://shippingcontainersoutback.com (the "Site"), you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Shipping Policy, Payment Policy, Sales Tax Policy, Returns & Refund Policy, Warranty Policy, and Cookie Policy, each of which is incorporated by reference. If you do not agree to these Terms in full, you must not use the Site or purchase any products or services from us.

Eligibility to Use the Website

The Site and our services are intended for users who are at least 18 years of age (or the age of majority in their state of residence) and legally able to enter into binding contracts under U.S. law. By using the Site or placing an order, you represent and warrant that you meet these eligibility requirements, that all information you provide is accurate and complete, and that you have the authority to bind yourself or the entity on whose behalf you are transacting. Purchases are available to customers with a valid U.S. billing and shipping address; international purchases are considered on a case-by-case basis. We reserve the right to refuse service, terminate accounts, cancel orders, or restrict access at our discretion where permitted by law.

Definitions

"Container" means any new, one-trip, used, refurbished, or custom-modified intermodal shipping container or modular structure offered for sale. "Order" means an executed request to purchase Products or Services, whether placed online, by phone, by email, or through a signed quote or invoice. "Products" means Containers, modifications, accessories, and any other tangible goods offered for sale on the Site. "Services" means delivery, site coordination, modification, installation, financing facilitation, and any related services offered by us. "Quote" means a written estimate provided by us describing pricing, specifications, and validity period. "Delivery Location" means the customer-provided address where the Product is scheduled to be delivered.

Products and Services

Outback Shipping Containers LLC sells new (one-trip), IICL, cargo-worthy (CW), wind-and-watertight (WWT), as-is, and custom-modified intermodal shipping containers in standard sizes including 10ft, 20ft, 40ft, 45ft, and 53ft, in standard and high-cube heights, and in specialty configurations such as refrigerated, open-side, open-top, double-door, and flat-rack. We also offer container modifications including doors, windows, insulation, HVAC, electrical, paint, and structural cutouts, plus site coordination, delivery, and financing facilitation through third-party lenders. All Products and Services are provided subject to these Terms and any additional terms disclosed on the product page, in your Quote, or on your invoice.

Product Descriptions and Availability

We make commercially reasonable efforts to describe our Products accurately, including size, grade, condition, features, and photographs. Because used and refurbished containers are inherently unique, minor variations in paint color, surface rust, dents, patches, prior markings, floor condition, and hardware are normal and do not constitute a defect. Product images are representative and may not depict the exact unit you will receive unless a specific unit number is reserved on your invoice. All Products are offered subject to availability, and we reserve the right to correct errors, limit quantities, discontinue Products, or substitute a comparable or better unit when the specific unit becomes unavailable, in each case with prior notice to you.

Pricing and Currency

All prices are quoted in U.S. dollars (USD) and, unless expressly stated, do not include delivery, permits, cranes or specialty offloading, site preparation, sales or use tax, or modifications. Prices displayed on the Site are subject to change without notice due to steel-market fluctuations, freight rates, inventory turnover, and depot availability. The price applicable to your Order is the price confirmed in writing on your invoice or accepted Quote. Typographical errors, mispriced items, or system errors do not obligate us to honor an incorrect price; we will notify you and offer a corrected price or a full refund of any amount already collected.

Quotes and Estimates

Written Quotes are valid for the period stated on the Quote (typically 7 to 14 days) and are subject to inventory availability, freight-rate changes, and market conditions. Verbal estimates are informational only and do not constitute a binding offer. A Quote becomes a binding Order only when you accept it in writing (including by email confirmation, signed invoice, or online checkout) and we receive the required deposit or full payment as specified in the Quote.

Orders and Order Acceptance

Placing an item in your cart, submitting a checkout form, or accepting a Quote constitutes an offer to purchase, not a binding contract. An Order is accepted, and a contract is formed, only when we (i) receive the required payment or deposit in cleared funds and (ii) send you a written Order Confirmation or paid invoice identifying the Product, price, taxes, delivery terms, and estimated delivery window. Until we issue Order Confirmation, we may decline or cancel any Order for reasons including inventory unavailability, pricing or description errors, suspected fraud, failed payment authorization, or inability to deliver to your location.

Payment Methods

We accept Visa, Mastercard, American Express, and Discover credit and debit cards; ACH bank transfers; domestic bank wire transfers; and, where offered, financing through our third-party lending partners. All Orders are paid in full, except container homes priced above $15,000, which may be paid 50% upfront at Order Confirmation with the balance due on delivery. Wire and ACH payments are the preferred method for Orders exceeding $10,000. Certified funds may be required for express delivery. All payment details are described in our Payment Policy.

Payment Authorization

By submitting payment information, you represent and warrant that you are authorized to use the payment method, that the information you provide is true and accurate, and that you authorize us and our payment processors to charge the full Order amount, including any applicable taxes, delivery charges, modifications, and permitted adjustments, to that payment method. Payment card transactions are processed by PCI-DSS compliant third-party processors; we do not store full card numbers on our systems. In the event of a chargeback, dispute, or reversal that is later determined to be invalid, you agree to reimburse us for all resulting fees, collection costs, and reasonable attorneys' fees.

Taxes and Fees

Sales, use, excise, and similar transaction taxes are calculated based on the delivery address and applied at checkout or on your invoice in accordance with applicable state and local law. If you are tax-exempt, you must provide a valid, current exemption certificate before Order Confirmation; retroactive refunds of collected tax may be limited by state law. You are solely responsible for any permits, impact fees, HOA fees, or municipal charges related to placing the container at your Delivery Location. Shipping and Delivery Terms

Delivery timelines shown on the Site or in Quotes are good-faith estimates (typically 5 to 15 business days for in-stock domestic Orders) and are not guaranteed. Delivery times may vary based on depot availability, driver scheduling, permitting, weather, road restrictions, and force-majeure events. Risk of loss passes to you upon delivery to the Delivery Location or, if the driver is unable to unload due to site conditions, upon arrival at the Delivery Location. Title passes to you upon our receipt of full payment in cleared funds. Complete delivery terms are described in our Shipping Policy.

Delivery Requirements and Customer Responsibilities

You are responsible for confirming that the Delivery Location is legal, accessible, and prepared to receive the container. Standard tilt-bed delivery requires a level, compact, unobstructed area with at least 100 feet of straight approach for a 20ft container and 120 feet for a 40ft container, minimum 12 feet of overhead clearance, and adequate ground bearing capacity. You are responsible for verifying zoning, obtaining any required permits, marking underground utilities, and instructing our driver on final placement. If the Delivery Location is not accessible, is unsafe, or has not been prepared as required, you agree to pay any additional trip, storage, crane, or standby fees incurred, and we reserve the right to reschedule delivery at your expense.

Inspection Upon Delivery

You (or your authorized representative) must inspect the container at the time of delivery and note any visible discrepancies, damage, or condition issues on the delivery receipt or bill of lading before the driver departs. Photographs of any concerns should be taken and emailed to sales@outbackshippingcontainers.com within 48 hours of delivery. Failure to note issues on the delivery paperwork or notify us within 48 hours will be deemed acceptance of the container in the delivered condition, except for hidden defects covered by the applicable warranty.

Returns, Refunds, and Cancellations

Because shipping containers are large, heavy, and expensive to transport, Orders may be canceled only in accordance with our Returns & Refund Policy. In general, standard in-stock containers may be canceled before dispatch for a full refund less any incurred logistics fees; custom-modified containers and containers already dispatched are non-refundable, except for documented defects reported within the inspection window. Where a return is authorized, the container must be in the same condition as delivered, and roundtrip freight, restocking, and cleaning charges may apply. Warranty Information

New (one-trip) containers are sold with a manufacturer wind-and-watertight warranty (typically 5 years, subject to the manufacturer's terms). Cargo-worthy and wind-and-watertight used containers are sold with our 30-day Wind & Watertight Guarantee. As-is units are sold without warranty. Custom modifications performed by our shops are covered by a limited 1-year workmanship warranty. All warranty coverage, exclusions, and claim procedures are described in our Warranty Policy. EXCEPT AS EXPRESSLY STATED IN THE WARRANTY POLICY, THE PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Financing

We may offer or facilitate financing through independent third-party lenders. Any financing application is subject to the lender's underwriting, terms, and conditions and is a separate agreement between you and the lender. We do not extend credit directly, do not guarantee approval, and are not responsible for the lender's decisions, disclosures, fees, or servicing. If financing is not approved or is withdrawn, you remain responsible for paying the Order balance by an accepted payment method before dispatch.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUTBACK SHIPPING CONTAINERS LLC, ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR AN ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

Disclaimer of Warranties

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH IN OUR WARRANTY POLICY, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT PRODUCT DESCRIPTIONS, PRICING, OR OTHER CONTENT ARE ACCURATE, COMPLETE, OR CURRENT. Containers are industrial products intended for cargo storage and appropriate modification uses; suitability for any specific use (including habitation, food storage, or specialty applications) is your responsibility to determine with appropriate professionals.

Intellectual Property

All content on the Site, including text, graphics, logos, product photographs, 3D models, buyer's guides, blog articles, videos, code, and software, and the compilation and arrangement thereof, is owned by or licensed to Outback Shipping Containers LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. "Outback Shipping Containers" and associated logos are our trademarks. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written consent. Limited personal, non-commercial use to research and purchase our Products is permitted.

Website Use Restrictions

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You may not use the Site to transmit any harmful or unlawful content, to interfere with the Site's operation, to scrape or harvest data, to bypass any security measures, to attempt unauthorized access to any account or system, or to compete with our business by copying our product data, images, or descriptions.

User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update your account information as needed. You must notify us immediately at sales@outbackshippingcontainers.com of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms, appear to be used fraudulently, or remain inactive for an extended period.

Prohibited Activities

You agree not to: (a) use the Site for any illegal or unauthorized purpose; (b) submit false, misleading, or fraudulent information; (c) use another person's payment method without authorization; (d) resell, redistribute, or expose the Site's data, images, or product listings through automated means; (e) upload viruses, malware, or malicious code; (f) attempt to reverse engineer, decompile, or otherwise derive the source code of any Site technology; (g) harass, threaten, or defame our staff, customers, or partners; or (h) infringe any intellectual property, privacy, or contractual right of any third party.

Third-Party Services and Links

The Site may contain links to, or embed content from, third-party websites, tools, and service providers such as payment processors, financing partners, mapping providers, analytics services, and advertising platforms. We do not control and are not responsible for the content, availability, policies, or practices of any third party. Your use of any third-party service is governed by that party's terms and privacy policy. Third-party integrations are provided for your convenience and do not imply endorsement.

Privacy

Your use of the Site and our Services is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, share, and protect your personal information, including in connection with Google Analytics, Google Ads, and Google Shopping. Please review our Privacy Policy and Cookie Policy carefully before using the Site.

Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Site, or your purchase of Products or Services are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

Dispute Resolution

The parties will first attempt to resolve any dispute informally by contacting sales@outbackshippingcontainers.com. If a dispute cannot be resolved within 30 days of written notice, either party may pursue relief in the state or federal courts located in Harris County, Texas, and each party consents to the exclusive personal jurisdiction and venue of those courts. To the extent permitted by law, each party waives any right to a jury trial and any right to participate in a class action, private attorney general action, or consolidated proceeding. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Force Majeure

We are not liable for any delay, failure, or non-performance of our obligations caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, floods, fires, earthquakes, pandemics, epidemics, government orders, port closures, customs delays, trucking or driver shortages, fuel disruptions, war, terrorism, civil unrest, strikes, labor disputes, cyberattacks, and disruptions to steel, freight, or depot infrastructure. In the event of a force-majeure delay, we will notify you as soon as practicable and use commercially reasonable efforts to resume performance.

Indemnification

You agree to defend, indemnify, and hold harmless Outback Shipping Containers LLC and its officers, directors, employees, agents, affiliates, and suppliers from and against any and all claims, damages, losses, liabilities, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your breach of these Terms; (ii) your misuse of the Site, Products, or Services; (iii) your violation of any law or the rights of any third party; (iv) any modification, alteration, or use of a Product not authorized in writing by us; and (v) inaccurate information you provide regarding your Delivery Location, site conditions, permits, or authority to purchase.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these Terms, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Shipping Policy, Payment Policy, Sales Tax Policy, Returns & Refund Policy, Warranty Policy, and any Order Confirmation or invoice we issue to you, constitute the entire agreement between you and Outback Shipping Containers LLC regarding the Site, Products, and Services, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written. No waiver of any provision of these Terms will be effective unless in writing and signed by us. Our failure to enforce any right or provision is not a waiver of that right or provision.

Changes to the Terms

We may revise these Terms from time to time to reflect changes in our business, technology, applicable law, or industry practices. The current version will always be posted on this page with a "Last Updated" date. Material changes will be highlighted or, where appropriate, communicated by email to account holders and pending Order customers. Your continued use of the Site or placement of an Order after the effective date of an update constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
